Garden Values – Terms of Service

1. Eligibility

To use Garden Values, you must:

• Be at least 13 years old (or the minimum legal age in your jurisdiction),
• Have parental or guardian consent if under 18,
• Be legally capable of agreeing to these Terms.

Use of the Services is void where prohibited.

2. About Garden Values

Garden Values is a third-party, fan-operated platform that offers:

• Real-time item value tracking for Grow a Garden,
• A trade posting system,
• Trade history and logs,
• A live user chat system,
• Customizable user profiles,
• Interactive tools to assist with trades and market analysis.

Garden Values is not affiliated with, endorsed by, or partnered with Roblox Corporation or the developers of Grow a Garden.

3. Jurisdiction & Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law rules.

You agree that all disputes will be resolved exclusively in the state or federal courts of Delaware, unless submitted to binding arbitration as described herein.

4. Account Creation & User Information

To access certain features (such as trading, chat, or tracking tools), you must create a Garden Values account.

By creating an account, you agree to the following:

a. Information You Provide

You may be required to provide:

• A Roblox username or unique identifier,
• An email address (if applicable),
• Public-facing profile content (optional),
• Additional account metadata (IP address, browser info, device type).

You confirm that all information provided is accurate and that you have permission to use any username or profile data you submit.

b. Use of Your Information

By registering, you authorize us to:

c. Your Responsibilities

• Abuse platform features (e.g., spam, scam, impersonation),

By submitting content, you:

• Grant us a perpetual, worldwide, royalty-free license to use, reproduce, display, and adapt your content across Garden Values and affiliated sites,
• Warrant that your content is original or that you have the rights to share it,
• Agree not to post anything illegal, defamatory, misleading, abusive, or exploitative.

We reserve the right to monitor, remove, or moderate content at our discretion.

6. Trading Disclaimer

Garden Values provides estimated in-game item values and trade posting tools. However:

• We do not guarantee the accuracy of value listings.
• We are not responsible for the outcome of any trade, whether in-game or on our platform.
• We do not mediate or resolve trade disputes.
• Trades are simulated, community-driven, and for entertainment and reference purposes only.

You use all trade and chat features at your own risk.

7. Live Chat & Community Interaction

Our live chat system enables real-time user communication.

By using chat features, you agree to:

• Remain respectful and follow community guidelines,
• Refrain from harassment, spam, impersonation, or illegal behavior,
• Not share personal, sensitive, or financial information.

We are not responsible for what other users say or do. Report violations to our moderators.

We may restrict, mute, or ban users who abuse chat privileges.

8. Disclaimers

The Services are provided "as is" and "as available" without any warranties, express or implied.

We do not guarantee:

• That item values are accurate, current, or reflective of actual trades,
• That Services will be error-free, uninterrupted, or secure,
• That user interactions (via chat or trading) will be honest, appropriate, or safe.

We disclaim all warranties, including but not limited to:

• Fitness for a particular purpose,
• Non-infringement,
• Merchantability.

You assume full responsibility for your use of the Services.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

• Loss of data or digital items,
• In-game trade outcomes,
• Harassment or misconduct by other users,
• Account loss or unauthorized access,
• Downtime, bugs, or feature errors.

In no event shall our total liability exceed $100 USD or the amount you paid (if any) to Garden Values in the past 12 months.

10. Account Termination & Suspension

We reserve the right to:

• Suspend, restrict, or terminate your access at any time, with or without notice,
• Remove or moderate content or trade listings at our discretion,
• Ban users who violate these Terms, our community rules, or applicable laws.

Termination may result in the loss of your profile, data, and access to platform features.

You may also delete your account at any time by contacting us.

11. Dispute Resolution & Arbitration

Before initiating legal action, you agree to contact us first to attempt informal resolution by emailing [email protected].

If unresolved, you agree that:

• All disputes shall be resolved by binding arbitration in the State of Delaware, under the rules of the American Arbitration Association (AAA),
• You waive your right to a jury trial or class action.

Exceptions:

• Qualifying small claims cases may be brought in small claims court,
• We reserve the right to seek injunctive relief for abuse, fraud, or intellectual property violations.

12. Modifications to These Terms

We may update these Terms at any time. Changes will be posted on this page, and the "Last Updated" date will be revised.

Continued use of the Services after changes constitutes your acceptance of the revised Terms.
